Snow Removal Program

The RM of Britannia is offering snow plowing as an optional service this year for residences and businesses in the RM.
Rates:

$30.00 per flag Maximum of 15 minutes of snow removal
$100.00 for four(4)  flags Maximum of 15 minutes of snow removal/ Flag

Residents must sign a Snow Plow Liability Waiver and purchase a flag(s) from the RM Office in Lloydminster.

Snow Plow Liability Waiver

SNOW PLOW LIABILITY WAIVER AND INDEMNITY AGREEMENT

BETWEEN:
RURAL MUNICIPALITY OF BRITANNIA NO. 502 a municipal corporation in the Province of Saskatchewan (hereinafter referred to as the “Municipality”)
in the Province of Saskatchewan (hereinafter referred to as “The Land Occupant”)
WHEREAS the “Land Occupant” includes owner, purchaser, lessee, or occupant

AND WHEREAS the Land Occupant wishes to have the Municipality clear the access to the residence located at:

(hereinafter referred to as “the land”)


AND WHEREAS the Municipality has agreed, upon request and subject to certain terms and conditions, to clear the access to the residence.

NOW THEREFORE this agreement witnesseth that in consideration of the covenants and agreements hereinafter set forth, the Parties hereto covenant and agree to as follows:

  1. The Municipality hereby agrees that subject to certain terms and conditions, and the signing of the Agreement by the Land Occupant that it will, upon request, clear the access to the residential site on the land.
  2. The Land Occupant hereby agrees that they shall not bring any claim, action, suit, proceeding, or demand against the Municipality, its elected officials, officers, employees, servants, agents, and contractors with respect to any occurrence, incident, accident, or happening relating to the clearing of the access to the building site.
  3. The Land Occupant hereby agrees that they shall indemnify and save harmless the Municipality, its elected officials, officers, employees, servants, agents, and contractors with respect to any claim, action, suit, proceeding, or demand made or brought against the Municipality by any third party with respect to the clearing of the roadway by the Municipality on the Land, and which indemnity shall, without restricting the generality of the foregoing, include all legal costs incurred by the Municipality in defending such a claim, action, suit, proceeding, or demand.
  4. The Land Occupant hereby requests and authorizes the Rural Municipality of Britannia No. 502 to undertake to clear snow from the access to my residence.
  5. The Land Occupant understands that other than in case of an emergency, roads will be opened before my access is cleared.
  6. The Land Occupant understands that other than in case of an emergency, roads will be opened before my access is cleared.
  7. The Land Occupant acknowledges that if my access cannot be cleared by a motor grader due to obstructions of any sort or the lack of room to maneuver the equipment safely, the Municipality is relieved from any responsibility under this program.

IN WITNESS WHEREOF this Agreement has been executed by the Parties effective the day and year first above written notwithstanding the actual date or dates of execution.

BETWEEN:

a municipal corporation in the Province of Saskatchewan (hereinafter referred to as the “Municipality”)
in the Province of Saskatchewan (hereinafter referred to as “The Land Occupant”)
WHEREAS the “Land Occupant” includes owner, purchaser, lessee, or occupant

AND WHEREAS the Land Occupant wishes to have the Municipality clear the access to the residence located at:

  1. AND WHEREAS the Municipality has agreed, upon request and subject to certain terms and conditions, to the access into the property site for drive way maintenance and/ or custom work to be done.

I hereby request the Rural Municipality of Britannia No. 502 to undertake drive way maintenance and/ or custom work to be done as requested by land occupant at the above noted property and agree to the fees as outlined in the attached Custom Work Rate Agreement.

I understand that custom work will be done at the discretion of the foreman and on the availability of staff based on the priorities of labor at that time.

I have signed the Liability and Waiver Indemnity Agreement.

I agree that if my access cannot be made by a motor grader due to obstructions of any sort or the lack of room to maneuver the equipment safely, the Municipality is relieved from any responsibility under this program.

Dust Control Program

The RM of Britannia is offering Dust Control as an optional service this year for residences and businesses in the RM.

The RM will provide 200 meters of dust control at $2.50/metre per site, then at a rate of $5.00/meter cost for each meter beyond 200.

To receive dust control, you must apply and payment must be received prior to dust control being applied.

General:

  • RM will provide up to 200 meters of dust suppressant per site at a cost of $2.50 per lineal meter
  • $5.00 per lineal meter for anything beyond 200 meters, or if additional length is required to ensure there is no stretch of non applied surface of less than 50 meters (between separate locations)
  • Ratepayers must apply for application, with the deadline being May 31st in each year
  • Application and payment must be received before consideration will be given to the request

Information:

  1. Dust abatement program is operated under the guidelines of Policy TS-007 and this form is considered “Schedule A” to the policy.
  2. Submission of this form is for one (1) application only.
  3. Suppressant application will be carried out under the direction and discretion of the Operations Manager, and will be undertaken as time and resources permit. There is no guarantee on suppressant application within a specified time frame, as application can be done at any time within the period of time between June 1st and September 30th.
  4. The applicant agrees and acknowledges that there is no guarantee as to the life expectancy of the suppressant.
  5. The applicant acknowledges that the Municipality reserves the right to scarify, blade, and/or gravel those portions of road that have received dust abatement, if in his opinion, the road surface is no longer safe for the travelling public. In this event, the ratepayer shall not receive reimbursement or replacement of any of the dust abatement product.
  6. The municipality shall not be required to re-apply dust suppressant if the road is maintained and any subsequent application for dust abatement will require the ratepayer to re-apply in order to be considered, along with payment.
  7. Application will be based on a width of eight (8) meters, or to such width as the Operations Manager determines is appropriate.
  8. The applicant agrees to remise, release and forever discharge the Municipality, its officers, contractors, agents, servants successors and assigns of and from all manner of actions, causes of actions, suits, debts, dues, accounts, covenants, contracts, claims and demands for any damages to real and personal property, owned or occupied by them; and further agrees to indemnify the Municipality against all liabilities, costs, suits, claims, demands, action and causes of action of any kind of which the Municipality may become liable by reason of the application of dust suppressant material to the roadway, or any injury of damage to property occasioned to or suffered by any person or property, crops, trees, or livestock by reason of the application of dust suppressant material to the roadway.

All applications must be received by: May 31st in each given year.
